1. About These Terms

This website, legacy-arts.com, is operated by Legacy Arts, a business of Hofmann's Family Co LLC ("Legacy Arts," "we," "us," or "our"), located at 400 S LBJ Dr, San Marcos, Texas 78666. By visiting our website or buying from us, you agree to these Terms of Service and our Privacy Policy, Shipping Policy, and Refund Policy. If you don't agree, please don't use the site.

2. Products and Pricing

We work to describe and photograph our products accurately, but colors on your screen may differ from the actual product, especially paints, pigments, and inks.
Prices and availability can change without notice. We may correct pricing or listing errors and cancel or refund any order affected by one.
Inventory is shared between our online store and our retail shop, so an item may occasionally sell out before your order is processed. If that happens, we'll contact you and refund the item.
We may limit quantities and refuse or cancel any order at our discretion.

3. Orders and Payment

Placing an order is an offer to buy. It becomes final when we confirm it and ship or prepare it for pickup.
Payment is processed securely through Shopify Payments and our other payment providers. We don't store your full payment card details.
Sales tax is collected where required by law.

4. Shipping and Pickup

Shipping methods, rates, and timelines are described in our Shipping Policy. Local pickup and curbside orders are ready when you receive a pickup confirmation. Please bring your order number and photo ID. Once an order is handed to the carrier, delivery times are estimates and are outside our control. Orders not picked up within 2 days may be canceled and refunded.

5. Returns and Refunds

Returns, exchanges, and refunds are governed by our Refund Policy.

6. Safe Use of Art Materials

Some art supplies, such as solvents, spray paints, resins, solders, fluxes, and blades, can be hazardous if misused. You're responsible for reading product labels and safety data sheets and for using materials as directed, with proper ventilation and protective gear. Some products carry age restrictions or can't be shipped to certain locations, and we may cancel an order where shipping isn't permitted. Keep art materials away from children and pets.

7. Accounts

If you create an account, you're responsible for keeping your login secure and for activity under it. Please give accurate information. We may suspend or close accounts that are used fraudulently or abusively.

8. Intellectual Property

All content on this site, including the Legacy Arts name, logo, mascot, graphics, product descriptions, and photographs, belongs to us or our licensors and is protected by copyright and trademark law. Brand names and product images of other companies belong to their owners. You may not copy, reproduce, or use our content for commercial purposes without written permission.

9. Acceptable Use

You agree not to misuse the site, including by attempting to break or bypass its security, scraping it in bulk, submitting false orders, or using it for anything unlawful.

10. Disclaimer of Warranties

The site and products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. Manufacturer warranties, where they exist, are provided by the manufacturer.

11. Limitation of Liability

To the fullest extent allowed by law, Legacy Arts and its owners, employees, and affiliates aren't liable for indirect, incidental, or consequential damages arising from your use of the site or products. Our total liability for any claim is limited to the amount you paid for the product at issue. Nothing in these Terms limits rights you have under applicable consumer protection laws.

Our site may link to or rely on third-party services, such as Shopify, shipping carriers, and payment providers. We're not responsible for their content or practices.

13. Governing Law

These Terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in Hays County, Texas, and you consent to their jurisdiction.
